The Attorney General’s Office announced yesterday that the investigating authority has ordered the detention of the Sales Manager of (the state NOC subsidiary) Brega Oil Marketing Company, and the Directors of the following five fuel distribution companies: Al-Sharara Al-Dhahabiya, Libya Oil, Al-Rahila, Highway Services, and Al-Thiqa Al-Dawliya.
The Attorney General’s Office reported that the Directors of these five distribution companies failed to fulfil their duty to always make the received fuel available to the public. They also neglected their commitment to ensure that their distribution outlets adhered to contractual regulations.
Disbursement of fuel quantities to distribution outlets lacking valid licenses
The Attorney General’s Office revealed that its Deputy Prosecutor investigated, which revealed harm to the public interest. This harm resulted from some company Directors authorizing the disbursement of fuel quantities to distribution outlets lacking valid licenses, enabling other outlets to receive fuel despite their proven association with fuel smuggling groups. It also reported some Directors' arbitrary withholding of fuel distribution due to dissatisfaction with allocated quotas.
Disbursement of fuel quantities to fictitious distribution outlets
Furthermore, the failure to designate certain distribution outlets based on GPS location outside Libyan territory—at sea—created a situation that facilitated the disbursement of fuel quantities to fictitious distribution outlets.
In the same investigation, the investigator confronted the sales manager of Brega Company with the fact of abuse of the job entrusted to him by enabling private legal entities to obtain fuel without clarifying the reason for their benefiting from the subsidy that legislation had decided for ordinary citizens.
Thus, the Public Prosecution ordered the detention of the accused pending investigation and directed the suspension of thirty-six distribution points that do not engage in regulated commercial activity, and the prosecution of the rest of those involved in this behaviour that is harmful to the rights of the population and the economy.
